Legal feud sharpens at Santa Rosa City Hall
Santa Rosa’s city attorney incorrectly told council members they would be committing a crime if they publicly discussed details of last year’s labor negotiations with firefighters, Councilwoman Julie Combs said.
Combs said a legal opinion she obtained recently from the state Office of Legislative Counsel directly contradicts the advice City Attorney Caroline Fowler gave to the council about criminal penalties under the Brown Act, the state’s open meeting law.
She said Friday that the opinion supports her view that the council has been getting bad legal advice meant to "create a chill on Will Sutton Jersey transparency and openness." She said she plans to call Tuesday for "a review of our legal team," including outside attorneys hired by the city.
"We have a rogue city attorney who interrupted a council member and threatened all of the council and who has not been held accountable for her incorrect interpretation of the Brown Act," Combs said.
The rhetoric promises to deepen the dysfunction at City Hall, where long simmering resentments between some council members and city staff have strained working relationships and at times Authentic Kyle Fuller Jersey flared into public standoffs.
In a statement, Fowler declined to comment directly on the legal opinion "since Ms. Combs has not extended me the courtesy of advising that she intended to raise this issue or provided me with a copy of the letter."
The legal issue stems from a tense exchange between Fowler and Councilman Kyle Fuller Youth Jersey Gary Wysocky at the Oct. 15 City Council meeting. Wysocky was asking about the kinds of information he could disclose publicly about the city’s contract negotiations with firefighters, who received a 4.5 pay increase over the course of the new three year deal.

Afterward, Combs sought out her own legal counsel and was put in touch with Paul Boylan, a Davis based attorney who she called a First Amendment specialist and expert on open government law.
In a statement, Boylan said he reviewed a recording of the City Council meeting and was "perplexed" by Fowler’s statement about criminal penalties.
"I firmly believed that criminal liability for violating any part of the Brown Act was only possible if the person violating the Brown Act did so with the intention of depriving the public of information," Boylan said. "It appeared that the City Council member’s intent was to share information, not hide it, so there was no chance of any criminal consequence."
Boylan was also hired by Wysocky to represent him during the six month long personnel investigation that could lead to his censure Tuesday. The probe concluded he violated the city’s code of conduct by being abusive to city staff and disrespectful to the mayor in the tense days following the Andy Lopez shooting.
Weighing in on the Brown Act issue, Boylan suggested Combs ask Fowler to provide justification for her interpretation. Fowler cited a 2012 memo from Riverside County District Attorney Paul Zellerbach that took the same position.

Noreen Evans, an attorney and former Santa Rosa councilwoman, for help in clarifying the issue. The senator asked the Office of Legislative Counsel what violations of the Brown Act can be criminally prosecuted.
The Office of Legislative Counsel is the non partisan state agency that drafts legislative proposals and provides legal opinions and other legal services to the Legislature.
In a May 16 letter, state Legislative Counsel Diane Boyer Vine found that the Brown Act only calls for criminal penalties when a member attends a closed session where an action is taken and "the member intends to deprive the public of information to which the member knows or has reason to know the public is entitled."Since then, the Legislature has added the misdemeanor punishment provision to the Brown Act. It applies only in the narrow instance of officials knowingly making a decision in secret to hide what they know should be pubic information, Boyer Vine wrote.
The Press Democrat provided Fowler a copy of the opinion Monday. Fowler noted that Wysocky hadn’t advised her in advance of the Oct. 15 meeting that he planned to raise the issue of the closed door negotiations over the firefighters’ contract.
She provided the advice she did "based on information I had at the time without the benefit of any additional research," she said in her email Monday.
"I stand by the statement that he is precluded from disclosing closed session information and I would clarify based on additional information that I am now aware of that there is a difference of opinion regarding possible sanctions for such conduct," Fowler said.
She added that, regardless of such differences of opinion, "the bottom line is that the law is clear that such disclosure is prohibited without the consent of the legislative body except in very narrow circumstances."
Combs received the state opinion in mid May but said she only released it after the recent primary election, in which Wysocky lost his bid for the county’s top financial post. She denied she was releasing it in an effort to deflect attention from her embattled colleague’s censure vote. She noted that the legal advice Fowler offered preceded by two weeks the behavior for which Wysocky came under investigation.
Combs said she hoped the opinion would make council members feel freer to discuss decisions that happen behind closed doors, leading to greater government transparency.
"We have a culture of secrecy, and we have a culture of ’Caroline is always right,’" Combs said.
Combs and Wysocky both voted against the firefighters’ contract, expressing concern over the city’s ability to pay what they considered inflated salaries.
